Welcome to DEATHWORLD. These Terms of Service ("Terms") govern your access to and use of our website, products, and services (collectively, the "Services"). By accessing or using any part of the Services, you agree to be bound by these Terms. If you do not agree, you may not access or use the Services.

1. Company Information

DEATHWORLD operates this website and online store. For the purposes of applicable law, DEATHWORLD is the merchant of record.

2. Eligibility

You must be at least the age of majority in your jurisdiction to use the Services. By using the Services, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

3. Products & Print-on-Demand Fulfillment

All products sold by DEATHWORLD are made to order using third-party print-on-demand manufacturing and fulfillment partners.

As a result:

Products are created only after an order is placed.
Minor variations in color, print placement, fabric texture, or sizing may occur and are not considered defects.
Product images are mockups and are for illustrative purposes only.

By placing an order, you acknowledge and accept these characteristics of print-on-demand production.

4. Orders & Acceptance

All orders placed through the Services are subject to acceptance by DEATHWORLD. We reserve the right to refuse, cancel, or limit any order at any time for any reason, including but not limited to:

Errors in pricing or product information
Suspected fraud or unauthorized activity
Violation of these Terms

If your payment has already been processed and your order is canceled, you will receive a refund in accordance with our Return & Refund Policy.

5. Pricing, Taxes & Payments

All prices are displayed in the applicable currency and are subject to change without notice.

You are responsible for:

All applicable taxes, duties, customs fees, and import charges
Providing accurate billing and payment information

Failure to pay applicable charges may result in delayed or canceled orders.

6. Shipping & Delivery

Shipping times are estimates only and not guaranteed. Production and delivery times may vary based on location, demand, carrier delays, or customs processing.

DEATHWORLD is not responsible for:

Delays caused by carriers, customs authorities, or force majeure events
Lost or delayed packages once handed over to the shipping carrier

Risk of loss transfers to you upon delivery to the carrier, to the maximum extent permitted by law.

7. Returns, Refunds & Cancellations

All returns, refunds, exchanges, and cancellations are governed exclusively by our Return & Refund Policy, which is incorporated into these Terms by reference.

By placing an order, you acknowledge that:

Most items are non-returnable due to being made to order
Orders cannot be canceled once production has begun

8. Intellectual Property

All content available through the Services, including but not limited to clothing designs, artwork, graphics, logos, product designs, text, images, and branding (collectively, the "Content"), is the exclusive intellectual property of DEATHWORLD and is protected by copyright, trademark, and other applicable laws.

You may not:

Copy, reproduce, modify, distribute, sell, or exploit any Content
Use our designs for commercial or non-commercial purposes
Remove or alter any copyright or proprietary notices

Purchasing a product does not grant you any ownership or license to the underlying designs.

9. User Conduct

You agree not to:

Use the Services for unlawful or fraudulent purposes
Infringe upon our intellectual property or the rights of others
Attempt to interfere with or compromise the security or functionality of the Services
Submit false, misleading, or abusive content

We reserve the right to suspend or terminate access to the Services for violations of this section.

10. Third-Party Services

The Services may rely on or integrate third-party services, including Shopify, payment processors, fulfillment providers, and shipping carriers.

We are not responsible for the actions, policies, or failures of third-party services. Your use of such services may be subject to their own terms and policies.

11. Disclaimer of Warranties

The Services and all products are provided "as is" and "as available", to the maximum extent permitted by law.

We disclaim all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

To the maximum extent permitted by law, DEATHWORLD shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services or products.

In no event shall DEATHWORLD’s total liability exceed the amount paid by you for the product giving rise to the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless DEATHWORLD from and against any claims, damages, losses, liabilities, costs, and expenses arising from:

Your breach of these Terms
Your misuse of the Services
Your violation of any law or third-party rights

14. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Israel, without regard to conflict of law principles.

Any disputes shall be resolved exclusively in the competent courts located in Israel, unless otherwise required by mandatory consumer protection laws.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Updated Terms will be posted on this website with a revised "Last updated" date. Continued use of the Services constitutes acceptance of the updated Terms.

16. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and DEATHWORLD regarding the Services and supersede any prior agreements or understandings.
